What is the Seller Disclosure Regime and what does it mean for real estate agents?

The introduction of the Seller’s Disclosure Regime follows the passing of the Property Law Bill 2023, which replaces the Property Law Act 1974. Under the new laws, property sellers must provide a prospective buyer with a disclosure statement and prescribed certificates before a contract of sale is signed. This applies to both residential and commercial properties, and real estate agents are now responsible for preparing and delivering these documents on behalf of sellers.

The REIQ has provided further guidance to help agents fully understand these requirements.
